We hereby submit that we had purchased a club membership for availing holiday packages from M\s. CASA RETREAT PVT LTD which had its registered office at No.32 Castle Street, Ashok Nagar, Bangalore 25 for a period of three years starting from 8th March 2009. We availed their holiday package three times during this period. (Copy of agreement enclosed) We wanted to continue the membership and accordingly we renewed our membership on 24th February 2012 for a further period of three years. (Copies of bills enclosed) We wanted to take our holiday this year to Manali in Himachal Pradesh and accordingly sent a request letter to Mr. Ravi of Casa Retreat Ltd on 6th June to arrange for our holiday in during the month of September. As per his request we sent him the exact dates of our proposed holiday by e-mail dated 20th June 2014. We followed it up by sending him several e-mail reminders and he reassured that he would be sending us the holiday confirmation through his e-mails dated as follows: • 26th June 2014 • 28th June 2014 • 28th July 2014 • 5th August 2014 • 7th August 2014 • 19th August 2014 But despite all his promises and after several attempts to call him on the phone he failed to send us the confirmation. In the meantime we had booked our Air tickets to Kullu through Air India and as cancelling these tickets would result in heavy financial losses we were forced to book our Hotel accommodation on our own and visited Manali from 22nd September to 25th September 2014. We spent Rs.9477.00 as accommodation charges at Hotel Snow Valley Resort at Manali. We feel that this is clearly a case of deficiency of service. Besides this, for the Holiday that he arranged for us at Goa in February this year we had to pay Rs.6600.00 (voucher attached). He subsequently promised to return Rs.2500 but till now he has not done so.
Refund the amount spent on the hotel at Manali which is Rs.9477.00 and pay back Rs.2500 that he owes us and one third of the membership fee of Rs.14500 since we do not want to avail the third year holiday package. That is a total of 9477+2500+4833.33 = Rs.16810.33
