eBay Seller Sold Faulty Lava Iris – No Guarantee

After Purchasing Lava Iris 500 (PaisaPayID – 38123442962) from eBay seller lava_estore on 14/12/2014 we received a defective product on 22/12/2014. My registered claim (ID: 811002) for refund was rejected on a basis that was subsequently proved to be wrong by me by submitting adequate proof. eBay agreed for a replacement on 8/1/2015 & asked me to reship the product back to the seller for replacement. Seller received it on 9/1/2015. According to eBay policy we should have received the replaced product by 18/1/2015, the failure to which entitles me for a refund. We called eBay on 19/1/2015 notifying them about this issue. I was assured of a response within 48 hrs. Instead we received the product on 21/1/2015 which was shipped on 20/1/2015 by seller thus violating eBay policy. We also found the replaced product has defects (Flip cover and Back cover are not fitting properly and the issue not covered under manufacturer warranty according to Lava service center) which we had earlier. I have attached receipt of the seller’s courier shipment shipped on 20/1/2015.

Rs. 4535 (Product) + Rs. 511 (Reshipping charges). I have not been able to use the product ever since I bought the product on 14/12/2014 to the day of this complaint was filed (around 40 days). I have had to make around 10 calls and send 2-3 emails to eBay, and visit Lava service center 3-4 times before making any progress. Seller was unresponsive.

I want refund of the money I have spent as I am fed up of the unresponsiveness seller and lack of support of eBay.
