Harassment by SBI Baguihati Branch Kolkata

May it please your honours : This complaint petition is being filed on behalf of Shri Sukumar Mondal,a senior citizen aged 67 years , and a Central government Pensioner, a resident of Vill – Durgachak ( Uttarpally), Post + PS – urgachak, Dist.- Purba Medinipur,West Bengal, PIN-721602,referred to hereafter as Complainant, and is as follows : 1 That this complaint Petition is being filed under Sec. —- of the Consumer Protection Act. 2 The complainant is a pensioner drawing his pension from the State Bank of India, Haldia Port Branch code 1360, at Durgachak Dist.-Purba Medinipur WBPIN 721602, through S B A/c No. 3093XX34136 MICR IFSC SBIN0001630 (Core Banking Sercvice Branch ) regularly. 3 That the complainant wanted to with draw money from his account and approach to the S B I Baguihati Branch Kolkata on April 26,2017 and sought for token from the respective man attending the counter at that SBI Baguihati Br. ,issuing token as is the practice followed all SBI Branches through out India.

That the complainant was asked to take permission from the Branch Manager for withdrawing money through cheque 5 That the complainant met the Branch Manager for permission and I was advised to withdraw through ATM . When it was pointed out that I prefer to drawn through cheque as I am not well conversant with ATM usage the Branch Manager directed for drawing a cheque more that Rs.40 000/- then only he can permit me for cash withdrawal through Cheque 6 The Complainant dran a cheque of Rs.40 010/- and produced before him for permission which enraged him and he refused to allow permission to withdrawn money though chq.

The Complainant beg to drawn your attention to the following facts: (a) There is no instruction circular issued by SBI or Reserve Bank of India as on date barring Cash withdrawal through chq. (b) There is no instruction circular issued by SBI or Reserve Bank of India as on date that before taking token permission from the Branch Manager has to be taken for any cash withdrawal (c) There is no instruction circular issued by SBI or Reserve Bank of India as on date that cash withdrawal is not permitted through a chq. of Rs.40 010/- 8 The complainant painfully observe that the Branch Manager of SBI, Baguihati Branch, was rude and uncivilized in behaving with a customer ,a senior citizen pensioner and illegally refused to allow cash withdrawal from his pension account 9 The complainant painfully observe that due to such illegal action and rude and un-civilsed behavior of the Branch Manager, the complainant a senior citizen pensioner , was harassed , put in trouble financially and emotionally, on a humid day with scorching heat outside . 10 The complainant painfully observe that online complain made to the SBI Authority was not properly addressed and through a mail it was communicated _ “ ” 11 The complainant now approach to the Honble Consumer Court, praying for a compensation to the tune of Rs. 1 00 000/- from the State Bank of India for (a) Acting illegally –and whimsically , barring issue of token for cash withdrawal to a pensioner with out permission from the Branch Manager (b) Refusing to allow cash withdrawal illegally, (c) Harassing a senior citizen Pensioner not allowing to withdraw cash from his own Pension account (d) Misbehaving with a senior citizen Pensioner (e) Putting a senior citizen Pensioner in Financial trouble (f) Humiliating a senior citizen Pensioner emotionally (g) SBI authority not acting properly in redressal of the complain lodged on line PRAYER In view of the submissions contained in the preceding paragraphs, the complainant most respectfully prays to the Honb’le Forum to direct the Opposite Parties to : (i) Pay a sum of Rs. 1 00 000/- towards the (i) physical strain and (ii) mental agony and (iii) personal humiliation (iv) loss of self respect and (v) financial trouble to him and his family members,suffered by the complainant, a senior citizen Pensioner, as (compensation) and (iii) pay a sum of Rs.10,000/- towards cost of this petition (Cost) ; (iv) Any other order which honorable District Consumer forum deem fit and necessary.
