Homeshop18 – No Refund given for wrong product

Dear Sir/Madam I Bought a combo of loafers (Blue and Black – Size 9) from HS18 website, On 23rd april I got delivery of product which was Brown Loafers with blue laces and Black loafers of size 8. I then Registered a complaint (#130691983) on same day (23rd april) for return of the product as it was not matching the actual product specification that I ordered. I was asked to pack the product as is for courier person to collect it which was picked up after couple of days. I was told that my money will be refunded after the product reaches HS18 After few days when I called up their customer care I was surprised to hear the answer from them as they said “We have got information from warehouse that this product was used”. Now, Firstly I complained on the same day I received the product, secondly I think any sound person (having fashion sense) would never wear Brown Shoes with blue laces and for second shoe how could I wear the shoes that doesn’t even fit me as they were smaller in size. I spoke to one of their TL Mr Neeraj on 14th May and he understood my problem and transferred my call to Escalation desk where the lady (forgot her name) told me that she will close this dispute in couple of days and then will raise a request for refund and she also asked me to call again after 3 days to know the status. Whe I again called customer care to know the status I was again told that my product is used so nothing will be refunded. I had a chat with Mr Gaurav Singh (Escalation Desk) I asked him to send the snapshot for my product which he disagreed saying “we can not share snapshot with customer”, then I asked him to return the same product as I will raise this matter in consumer court by showing them from where does that product looks like an used product, he refused on that too saying ” we can send back your product as this is against the company policy”. Now they are not giving me any refund, nor they are returning the product that I sent them and also they are not willing to provide me the snapshot of product (which they are saying is used). No company has right to keep the product for which customer has already paid for. Who will gurantee that this product was not used by HS18 Staff from the day the courier boy collected packet from my home to till date I would like you to please take a strict actiaon against this company as it is clearly against ethics where they are keeping the money of customer but not ready to send the product.

I want my refund cheque of Rs 1698/- and also would suggest to take a Strict action against Mr Guarav Singh (Escalation Desk) who very rudely said that we cannot send you the snapshot, neither the product and nor the refund.
