1. That the complainant purchased a iBall Slide 3GQ1035 tab online with serial No.911336450084823 from Flipkart.com on 7th of April 2014 for a sum of Rs.14489/-. 2. That on 7th of April 2014 the iball 3GQ1035 tab was delivered to the complainant and Order Id OD40407045456 for the payment of Rs. 14489/- was given by Flipkart Delivery Person. 3. That the iBall 3GQ1035 tab thereafter developed certain fault for which repeated complaints were made to the opposite party. However, the opposite party failed to rectify the said faults satisfactorily. 4. That on September 23, 2014 a iball 3GQ1035 tab was delivered at the Service Centre of the opposite party Best it World India Pvt.Ltd Pune, for service and removal of defect but, the opposite party failed to rectify the faults. 5. That the iBall Slide 3GQ1035 tab has a warranty for a period of one year. 6. That the cause of action arose on September 08, 2014 when the iBall Slide 3GQ1035 tab developed certain faults with regard to screen display as mentioned above. The cause of action further arose on September 23, 2014 when for the second time the complainant had to again take the iBall tab for repeat removal of defects/faults.
a. Immediately rectify the defect in the gadget iball 3GQ1035 tab. b. Order the opposite party to pay Rs. 5000/- as compensation and Rs.1000/- as costs;
