A mobile set, Model – KC540, IMEI No.- 911230350219813 was purchased at Varanasi in U.P. on 02/03/2013. The set was handed-over to service centre on 20/09/2013 for repair under warranty when was not functioning properly . Almost after 03 months, the set was returned to me on 23/12/2013. After formal checking I received it. But while using, I came to know that still it is not functioning properly. The very next day, I again shown it to service centre and after checking they have taken on 24/12/2013 (Service Job Sheet is attached as Annex.-III). Approx. 29 correspondences (Attached as Annex.-IV&V) are made between me and ‘customer support’ through email (support@ karbonnmobiles.com) for early repair and return of the set avoiding monitory loss because of disconnected contacts due to non-functioning of my CDMA number. T
The CDMA SIM can only be used with the set. On 15/01/14 an email has been sent by me that if the set is not replaced within 15 days, I will have no option but to go to consumer court (at 44/82 of Annex.-IV). On 18/01/14, I was informed that the set cannot be replaced /refunded (at 53/82 of Annex.-IV). On 21/01/14, I explained that why replacement is necessary (at 60/82 of Annex.-IV). On 25/01/14, I made clear that if the set is not provided within 05 days, to avoid monitory loss, I will have no option to buy a new one and thereafter only refund will be the next option (at 71/82 of Annex.-IV). When I still have not received the set, I purchased a new one and informed on 05/02/14 with request of refund of amount which I spent to buy old one (at 78/82 of Annex.-IV). On 07/02/14, I once again requested to return the amount of Rs. 2750/- within 10 days thereafter I will be free to go to consumer court with the matter (at 6/7 of Annex.-V). On 08/02/14, I was informed that it will take 15 days more but nothing has been done till date.
I demand Rs. 22,750/- [Rs. 2,750/- (Cost of mobile set) + Rs. 10,000/- (for monitory loss and loss due to time invested in correspondence) + Rs. 10,000/- for mental tension and harassment due to this.]
