Myntra.com – Defective Adidas Flip-flops – Review

1. That on 31st May 2014, the complainant purchased one Adidas Flip Flops, product code 308386, from the service providors online shopping portal,Myntra.com,vide order number 15965590 ,a copy of the invoice has been attached with this complain.The online seller,Myntra.com, and the brand,Adidas, promised a 3 months warranty against manufacturer defect. 2.That on 24/08/2014 the Adidas Flip Flop as provided by the service provider,Myntra.com, was found to be defective as the strap of the Adias Flip-Flop came off and the matter was immediately reported to the service provider via an detailed email and a telephonic conversation,both these complaints were duly acknowledged by the service provider, for invocation of warranty as promised by the manufacturer ,Adidas, which was also stated on the website of the service provider ie Myntra.com 3.That there were a series of email exchanges between the service provider and the complainant over next few weeks regarding invocation of warranty as promised by the service provider and manufacturer while selling the product,Adidas Flip-Flops.(copies of these email exchanges could be furnished if required). 4.That the Complainant in the meantime approached a local authorised vendor of the defaulter brand,Adidas, and showed them the defected product,The local vendor informed the complainant that the damage does fall under the ambit of “manufacturer defect” and the complainant is entitled to claim the warranty as promised. 5.That the defaulter website,Myntra.com, on 02/09/2014 with an email informed the complainant that they can not replace the defected Adidas Flip-flop and till date the Complainant is suffering due to the forgery and cheating commuted by the defaulter website,Myntra.com and Adidas as they dishonoured their promises made at the time of purchase of the defected product. 6.That this conduct of the online shopping portal Myntra.com and brand Adidas componds to breach of their duty towards consumer and its sheer exploitation of consumer and its rights. 7.That the website Myntra.com had supplied defective good and they have to make good the losses suffered by the complainant.

In view of the submissions contained in the preceding paragraphs, the complainant most respectfully prays to the Hon’ble Forum to direct the Opposite Parties to : (a) replace the defected Flip-flops with a new pair. (b) pay a sum of Rs. 10,000/- towards the physical strain and mental agony suffered by the complainant and his family members (compensation) ; and as penalty for breach of duty.
