SnapDeal – No Delivery of Product on commtted date

On 7th May 2014 I bought the product –“Dell E1913S 19 inch LED Monitor” vide Order number – 2065559440. At the time of purchase the expected shipping date was showing as “on or before 8th May 2014” (Annexure-I). Post passage of the 8th May 2014 and without even seeing the said order number was shipped, based on my status inquiry and refund demand (Annexure-II and Annexure-III) on 9th May 2014 snapdeal shipped the above said order late in the evening of 09.05.2014 (Annexure-IV). In the shipment note it was also mentioned that the shipment will be delivered to my address on or before 14.05.2014. On 12.05.2014 post communication with the courier company, I found although snapdeal committed the date of 14.05.2014 as delivery date, but the courier company is not going deliver before 17.05.2014. And I also asked snapdeal to look into this discrepancy (Annexure-V). But to my surprise on 12.05.2014 late evening snapdeal simply bypassed their responsibility and asked me to coordinate with the courier company (Annexure-VI). Immediately on 13.05.2014 I wrote back snapdeal, to either make provision for the delivery by 14.05.2014 within 6PM else they cancel the order and do refund. Also made it clear to snapdeal that shipment and delivery being the responsibility of the seller and its them who have to look into it. In the same communication I also mentioned that non receipt of any reply within next 2 hours (as snapdeal claims their customer service is open 24×7) would be treated as acceptance of snapdeal towards clauses mentioned by myself in the communications (Annexure-VII). This time also snapdeal simply choose to ignore the communication and bypass the responsibility and at the late evening of 14.05.2014 again writes me back saying to coordinate with the courier company (Annexure-VIII). An official refund request has also been put up with snapdeal (Annexure-IX), for which snapdeal is asking me to refuse the delivery for refund processing ((Annexure-X). When snapdeal themselves don’t even control the committed timelines for shipment and delivery how come they put everything on buyers. All the more when it’s not even clear about the items delivery where-about how can I trust snapdeal with the payment refund process (as from the very beginning they have showed non-cooperation and harassment attitude in this regard).

Refund of Rs. 7531 along with compensation.
