Spice mobile – defective condition Delay in replacement

Product – Spice Stellar Pinnacle Pro MI-535 mobile phone I had ordered the product on 13th Dec 2013 and received it on 17th Dec in defective condition. I contacted Saholic the very same day for replacement and they got the product picked up from my place for replacement on 19th Dec. They promised to reship the product as soon as they get the delivery at their warehouse. But, after receiving the product on 23rd Dec, they started saying that they will send the product for replacement to the manufacturer and as soon as they would get the replacement, they will reship it. Between 23rd and 27th Dec, I called them many times to get the status, but the customer care misguided me every time. Sometimes they said that the product will be delivered on 27th, sometimes they said that there was some problem and it will take unspecified time. I wanted to talk to some more responsible personnel from the company, but the customer care pleaded inability to get any managerial staff on the phone. On 27th Dec, at 6 PM, Saholic contacted me and said that the product will be reshipped “within next 10 mins”. From 28th Dec, I have been calling the customer care to get the AWB no. of the courier and the status of the shipment, but they are again misguiding me. Now they are saying that the product may not have been reshipped, and it may again delay due to new year holidays. This time again I requested to talk to any managerial staff, but as usual, the customer care pleaded inability to get them on line.

It is clear that the loss that I have suffered and that I am still suffering can not be compensated by Saholic, but the negligence that they have shown towards consumer rights should be appropriately penalized. For this purpose, I demand for a relief-cum-penalty of Rs. 50,000 along with earliest delivery of the replaced product.
