Infibeam – Non delivery of Purchased Product even after 2 Months of Payment

Dear Sir / Madam, I have made a purchase of iBall Andi 4.7G Cobalt (Wine) which is smartphone on 17th of August 2013 from Infibeam online shopping site, where it was clearly mentioned that the product is to be delivered within 07 days of making the payment. On 22nd or 23rd August I received a call from Overnite Courier that a product has arrived in my name and it has to be collected from their office. My job involves continuous travel and I hardly stay for a couple of days in a week in my home town. I asked the courier that it is not possible to collect it from their office and why did they accept the product when they could not deliver to the doorsteps of the consumer for which they are paid. The courier guys informed that they would be returning the product and just slammed the phone. Immediately I informed the same to the Infibeam online shopping site and the executive in the call centre promised to look and settle the issue. But a week passed there was no feedback from the company and in desperation I called them back again they informed me the product was returned back to their warehouse. Again the executive assured me that that I need not worry and the product would reach me in time in this attempt. I cautioned them that my job keeps me out of station most of the time and it is not possible for my wife to collect it from courier’s office and asked them to assign a separate courier this time which the accepted.

But this time too they sent the product by Overnite Courier and the same story got repeated. Then I made at least 10 to 15 calls to them and the executive employed by them always asked for forgiveness ( as if they are being paid to beg and lament for the inefficiency of their company ) and every time assured me that within 04 to 05 working days the product would reach me and each time they failed. Today it is 27th of October 2013 and I have still not received the product as yet. I have lost charm over the product now. Nonetheless even if the product is delivered to me now I want adequate compensation for delay, harassment and anxiety caused, time spent in making calls during which other works could have been carried out which would have enhanced my earnings and last but not the least the expenses incurred in making calls to their offices. Further as you are well aware that with each passing days the price of smartphones falls which can be easily viewed in their website itself. On 17th of August the price of the product was Rs.15,599/- and today in this day of making the complain, the worth of the same product is Rs.14,762/-, i.e. a fall of Rs.837/- in 72 days or a fall of Rs.11.625/- for a single day. In this regard I would like to know how should I proceed ahead so as to recover the aforesaid compensation at the earliest. Kindly advice and help me in my quest of justice.
