HAIER Refrigerator – fault in cooling repeated follow-up no response

Dear Sir, This is to bring to your kind notice that I had purchased one HAIER Refrigerator from your Tilak road branch For a consideration of Rs 14500/- paid in cash vide your cash memo/ Receipt/ Invoice No 59-PTR03-145DN 225 on 21-0314. The said good was suffering from following defect since it was delivered to me . 1) The cooling of refrigerator was not functioning (fault in cooling) a) After repeated follow-up and more than 15 calls the engineer from HAIER India visited my house on 25/03/2014 and gave his expert opinion that the compressor is not functioning and i will ask to get it repair. When I protested this suggestion and asked him to give me a replacement as I have just purchased it and it not my fault as it was not functioning from the date of delivery itself. I asked him for replacement as I had been delivered a faulty refrigerator. After repeated pleading he assured me that he will give a brand new replacement refrigetaor. I had reported the above matter to vijay sales service and HAIER customer care several times ( I had called both of your customer care at least 50 times which you can verify) but despite all my pleadings they had not made good the defect in the goods (or deficiency in services) which is indeed regrettable and highly unbusiness like. On 28/03/2014 I had threaten there customer care and area branch manager to lodge a consumer complaint if I do not get a replacement. On this warning they acted and delivered me a replacement good. But to my utter shock the new replacement product had scratches on front panel and on the top of the refrigerator and its front sticker was missing. It was clear sign that I had been delivered used and display piece even i had given full payment for new refrigerator. Their delivery person has duly acknowledged in writing that such refrigerator has scratches and it is prima facia appear that it is used one. He has also admitted in writing that it amounts to unfair trade practice and cheating on part of that company. On account of your aforesaid dereliction of duty and failure and neglect to rectify the same I had given them a notice for suffered losses/ incurred expenses 74,500/- to which they are liable to compensate me. (60,000/- for mental harassment and wastage of time and loss of opportunity to buy a good during festive season and 14,500/- price paid for your defective and used product.) Coin the sum of Rs 74,500/- .with interest @ 24.% per annum within 7 days of the receipt of this notice failing which I shall be constrained to initiate against you for redressal of my aforesaid grievances and recovery of the aforesaid amount such proceedings, both civil and criminal(cheating, mal practice, unfair trade practice) as are warranted by law, besides filing a complaint under the statutory provisions of The Consumer Protection Act, 1986 and other laws prevailing in the country exclusively at your own risk, cost, responsibility and consequence

I have asked them for compensation of Rs 74,500/- for my suffering and damages for mental harrasment. But a written apology to me in news paper and new refrigerator taking its warranty from the date of delivery would do for me. I am not after money but i want to teach them a lesson to this people who take a innocent consumer for granted.
